Trademarks, trade names, logos, domain names and any other distinctive signs (hereafter collectively referred to as “Distinctive Signs”) on the website www.smalvic.it (hereafter referred to as “Website”) and/or any other associated electronic resources and/or electronic communications networks and/or those connected to the Website are the exclusive property of Smalvic S.p.A. and/or its partners and/or Licensors and are protected at Italian, Community and international level. These cannot be used for any purpose, either wholly or partially, in their literal and/or figurative components, without the prior written consent of Smalvic S.p.A.and/or other rightholders.
The name “Smalvic” and other Distinctive Signs and variants thereof and any distinctive sign that includes Smalvic S.p.A. and/or Licensor trademarks and/or tradenames cannot be used as Internet addresses and/or domain names for other websites or parts of those addresses and domain names without the prior written consent of Smalvic S.p.A. and/or Licensors.
The trade names of Smalvic S.p.A. products to which the Website refers, are protected distinctive signs, irrespective of the manner in which they are shown. The names of other companies and/or their products may be trademarks of their respective owners. The use of such trademarks without the prior permission of the rightholders is expressly prohibited and may constitute an infringement of the law. All rights are expressly reserved.
It is forbidden to adopt a sign that is the same as or similar to the Distinctive Signs and/or the same as or similar to other marks published on the Website as a company, company name or title, sign and corporate domain name if this entails a likelihood of confusion on the part of the public, which may also involve a risk of association between the signs, due to the identity or affinity between the business activities of the holders of those signs and the products or services for which the mark is adopted.
The ban also extends to the adoption as a company, company name or title, sign and corporate domain name of a sign that is the same as or similar to the Distinctive Signs for products and services, even if they are unrelated, if the use of the sign without good cause allows undue advantage to be drawn from the distinctive character or renown of the Distinctive Signs or is prejudicial to them.
Anyone interested in using the Distinctive Signs for the sole and exclusive purpose of indicating the destination of products or services shall send a specific and detailed written request to the email address email@example.com taking care to specify:
a. the starting date for the use of the Distinctive Signs;
b. the type of activity for which the use of the Distinctive Signs is required;
c. the time period and territorial scope for the use of the Distinctive Signs;
d. a detailed list of the materials on which the Distinctive Signs are to be attached and a description of the media;
e. the layout and/or drafts of materials and/or content in relation to which the Distinctive Signs are to be used.
All the material listed above shall be received at least 60 (sixty) days prior to the date indicated under point a.
Smalvic S.p.A. reserves the right to grant or deny permission to use the Distinctive Signs and/or other signs that are directly or indirectly linked to it with the widest discretion and in accordance with the applicable laws. In any event, Smalvic S.p.A. has the right to deny its consent – and even to contest – the use of the Distinctive Signs in the absence of full and timely compliance with even only one of the above conditions.
Any unauthorised use of Distinctive Signs and/or any other distinctive sign directly or indirectly associated with it will be immediately pursued by Smalvic S.p.A in all competent jurisdictions.
The Website page contents cannot be copied, reproduced, transferred, downloaded, published or distributed in any way, in whole or in part, without the prior written consent of Smalvic S.p.A., without prejudice to the possibility of storing them on a personal computer or printing extracts from Website pages solely for personal purposes.
